1. Who we are
ChapaSwali ("we", "us", "the platform") is a real-time knowledge-competition platform operated by ChapaSwali, a business registered in Kenya. Our registered support address is support@chapaswali.com. By creating an account or using the platform, you agree to these Terms.
2. Eligibility
- You must be 18 years old or older.
- You must be a resident of Kenya with a valid M-PESA account.
- You must not be on any self-exclusion list maintained by us or by the BCLB (Betting Control and Licensing Board).
- You must use your real identifying details (phone, name) for cash withdrawals — KYC is verified through M-PESA name matching.
3. Skill, not chance
ChapaSwali matches are skill-based. Players answer five knowledge questions and are ranked by accuracy + response speed (millisecond-precision, server-stamped). The pool of questions is curated by our team. The platform does not bet on outcomes, does not run lotteries, and does not match players against the house.
4. Entry fees and prizes
- Entry fees per match are KES 10, KES 20, or KES 50 (the "Tier"). Tier prices are displayed before you join and may change with notice.
- 80% of the entry-fee pool forms the prize pool. The remaining 20% is platform commission, used to operate ChapaSwali.
- Prize pool distribution depends on match capacity. For 10 players, top three split 50% / 30% / 20% of the prize pool. See pricing.
- Prizes credit instantly to your in-app wallet upon match settlement. Cash-out via M-PESA is initiated by you, subject to daily caps.
5. Refunds
If a match queue does not fill within 5 minutes, your entry fee is refunded automatically. If a match is cancelled by us for technical reasons (e.g. server outage), all entries are refunded. We do not refund completed matches based on performance.
6. Caps and self-exclusion
Default daily caps apply: KES 10 000 deposit, KES 50 000 cash-out per user per 24 hours. You may self-exclude from deposits and match-joining for 1, 7, 30, or 90 days from account settings. Self-exclusions can be extended but not shortened by you; contact support for early lift requests.
7. Anti-cheat and fair play
We reserve the right to investigate and ban accounts that:
- Use automated scripts, bots, or accessibility tools beyond their normal intent.
- Operate multiple accounts to wash-trade entries.
- Coordinate with other accounts to manipulate match outcomes.
- Attempt to access server endpoints they're not authorised for.
Banned accounts forfeit any pending balance. We will email notice of the ban and the reason.
8. Payments and fees
M-PESA payments are processed via Safaricom Daraja. We do not charge a deposit fee. M-PESA transfer fees on cash-out (KES 10–110 depending on the amount band) are absorbed by us. Safaricom's standard tariff applies to your end.
9. Intellectual property
The questions, brand, design, and code of ChapaSwali are owned by ChapaSwali. You may not reproduce, scrape, or redistribute the question bank without written permission. You retain ownership of any content you submit (e.g. support messages); we have a non-exclusive licence to use such content for operating and improving the service.
10. Limitation of liability
ChapaSwali is provided "as is". We are not liable for indirect or consequential losses arising from use of the platform. Our total aggregate liability to you is limited to the sum of entry fees you have paid in the 90 days preceding the claim.
11. Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email at least 7 days before they take effect. Continued use of the platform after the effective date constitutes acceptance.
12. Governing law
These terms are governed by the laws of the Republic of Kenya. Disputes will be resolved in the courts of Nairobi.
